1. Acceptance of Terms

By downloading, accessing, or using the NoteNudge mobile application ("App"), provided by NoteNudge LTD. ("we", "us", "our"), you agree to be bound by these Terms of Service ("Terms"). If you disagree with any part of the Terms, you must discontinue use immediately.

2. Eligibility

You must be at least 13 years old to create an account or use the App. By registering, you confirm that you meet this requirement.

3. Account Creation and Responsibilities

Users must create accounts using email or social media accounts. Users must provide accurate information and are responsible for maintaining the confidentiality of account credentials. Users accept responsibility for all activities occurring under their accounts.

4. In-App Purchases and Premium Subscriptions

The app offers a Premium Subscription through in-app purchases. Pricing for this subscription is clearly indicated within the app and is currently set at CAD $16.00 per month. We reserve the right to adjust pricing with notice provided in advance.

5. Payments and Billing

All payments are handled via applicable app stores or authorized payment methods. Users agree to keep payment methods up to date to avoid disruption of services.

6. Refunds and Cancellations

Subscriptions auto-renew monthly unless canceled by the user before the next billing cycle. Users are responsible for managing subscription renewals. Refund requests are reviewed individually and issued at the company's discretion.

We provide refunds only in exceptional circumstances. Requests must be sent to [email protected].

8. Age Restriction

Users must be at least 13 years old. Individuals under 13 years of age are prohibited from using the App.

9. User-Generated Content

Users may create and upload courses. All content becomes the sole property of NoteNudge LTD. Users agree that they relinquish any intellectual property rights to content created within the app.

10. Content Moderation

Content moderation primarily occurs through community-driven mechanisms (e.g., downvoting inappropriate or poor-quality content). NoteNudge reserves the right to remove any content at its sole discretion.

11. Intellectual Property

All content generated within or by the app is owned by NoteNudge LTD. Users do not retain intellectual property rights to content created within the app.

12. Privacy and Data Handling

Users' data is handled per our Privacy Policy. We use third-party analytics and tracking tools. User data is retained for up to 10 years or until deletion is requested by the user.

13. Prohibited Activities

Users agree not to engage in any unlawful, harmful, fraudulent, or abusive use of the App. Such actions may lead to immediate account termination.

14. Liability and Warranty Disclaimer

NoteNudge LTD. provides the app "as is" without warranties of any kind. We shall not be liable for direct, indirect, incidental, or consequential damages, including but not limited to, data loss, downtime, or loss of revenue.

15. Termination

We reserve the right to terminate or suspend user accounts or access at our discretion, without prior notice, for violation of these terms or misuse of the app.

16. Governing Law and Arbitration

These Terms are governed by the laws of Canada. All disputes arising from or related to these Terms or the App shall be resolved exclusively through arbitration in accordance with Canadian arbitration laws.

18. Changes to Terms
